Article 299
Provisions regarding Speaker and Deputy Speaker
:(1) The Speaker and Deputy Speaker of the Legislature-Parliament existing at the time of commencement of this Constitution shall remain in their respective positions until another Speaker and Deputy Speaker are elected in accordance with this Article.
(2) If the session of the Legislature-Parliament is in progress at the time this Constitution is commenced, from the date of commencement of this Constitution and if the session is not in progress, within twenty days from the date of calling the session in accordance with Article 296 sub-section (6), the members of the Legislature-Parliament shall, on the basis of political consensus, appoint a Speaker and One deputy speaker will be elected.
(3) If the agreement according to sub-section (2) cannot be maintained, the member of the Legislature-Parliament who obtains the majority of the total number of members immediately existing in the Legislature-Parliament shall be deemed to have been elected to the position of Speaker or Deputy Speaker of the Legislature-Parliament.
(4) During the election according to sub-section (2) or (3), the Speaker and the Deputy Speaker shall be members representing different political parties represented in the Legislature-Parliament.
(5) The Speaker or the Deputy Speaker shall perform his duties in accordance with this Constitution as a neutral person, not in favor or against any political party.
(6) The office of Speaker or Deputy Speaker shall be vacant in any of the following cases:-
(a) If he resigns in writing,
(b) In the absence of his membership in the Legislature-Parliament,
(c) If the resolution that he has not behaved in a manner befitting his position is passed by a majority of at least two-thirds of the total number of members of the Legislative Parliament,
(d) In case of his death.
(7) The Deputy Speaker or any other member shall preside over the meeting to discuss the motion that the Speaker of the Legislative Parliament has not behaved in a manner conducive to the office and the Speaker shall be entitled to participate and vote in the discussion of such motion.
(8) Other procedures related to the election of the Speaker and Deputy Speaker and the procedure for submitting and passing the proposal that the Speaker or Deputy Speaker has not behaved in a manner appropriate to the position shall be in accordance with the rules of the Legislature-Parliament in force immediately.
